About the Service

Lecy is a service provided by NFGO, a French SAS registered with the Paris Trade and Companies Register under number 991 883 893, whose registered office is at 60 Rue François Ier, 75008 Paris (hereinafter “we”, “Lecy” or “NFGO”).

Lecy offers shops a loyalty solution based on an NFC tag, and consumers a simple, secure loyalty experience, compliant with the GDPR and with the features described on lecytap.com.

Registration and How the Service Works

2.1. For shops

A shop wishing to use Lecy must:

  • Create an account by providing the information requested (name, email, phone number, address, etc.).
  • Subscribe to the service under the pricing conditions in force.
  • Receive the NFC device(s) provided for its loyalty programme.

The shop may then:

  • Freely define and change the terms of its loyalty programme (number of visits required, rewards, etc.).
  • View the data of consumers who have interacted with its programme (contact details provided, points balance).
  • Add information about its business (links to social networks, website, descriptions, etc.).
  • Use the contact details provided by its customers to send them commercial communications related to its activity, in compliance with the GDPR.

2.2. For consumers

The consumer may:

  • Scan the NFC device of a participating shop to earn a loyalty point.
  • Be recognised automatically on subsequent visits thanks to the technologies in place.
  • Use their loyalty points once the threshold set by the shop is reached.

Providing personal data is optional for the consumer and gives access to additional features (recovering points, personalised communications, etc.).

User Commitments

By using Lecy, the shop and the consumer undertake to:

  • Use the service in accordance with applicable laws and regulations.
  • Comply with these Terms of Service.
  • Not divert the intended use of Lecy for illegal, fraudulent or harmful purposes.

The shop undertakes in particular to:

  • Not send unsolicited commercial communications to consumers without their prior consent where required by law.
  • Comply with the personal data protection rules applicable in Europe.

Rights of Lecy (NFGO)

NFGO reserves the right, at any time and without notice, to:

  • Suspend, restrict or remove access to the service for any user (shop or consumer) who breaches these Terms of Service or applicable law.
  • Terminate any subscription in the event of fraudulent or abusive behaviour, or behaviour contrary to the ethics of the service.
  • Modify, interrupt or discontinue all or part of Lecy’s features, temporarily or permanently, for legal, technical or commercial reasons.

NFGO may also:

  • Refuse access to the service to any user who does not accept subsequently modified terms.
  • Take any legal action to protect its rights and those of its users.

Intellectual Property

All elements of the Lecy service (website, application, NFC devices, trademarks, logos, text and graphic content) are the exclusive property of NFGO or its partners.

Any reproduction, distribution or use without express authorisation is prohibited.

Limitation of Liability

Lecy is provided “as is”.

NFGO does not guarantee the complete absence of errors, interruptions or malfunctions.

Under no circumstances shall NFGO be held liable for direct or indirect damage resulting from the use of, or inability to use, the service by a shop or a consumer.

Each shop remains solely responsible for:

  • The content of its promotional communications
  • Compliance with the laws applicable to its loyalty programme

Personal Data

Using Lecy involves the collection and processing of certain personal data, in accordance with the Privacy Policy available on lecytap.com.

NFGO strictly complies with the principles of the GDPR:

  • Minimal data collection
  • Transparent use
  • Enhanced security
  • No sale or abusive exploitation of personal data

Changes to the Terms

NFGO may modify these Terms of Service at any time.

Users will be informed of significant changes.

Any use of the service after a modification constitutes acceptance of the new terms.

Governing Law and Jurisdiction

These Terms are governed by French law.

Any dispute relating to their interpretation or performance falls under the exclusive jurisdiction of the courts of Paris, unless otherwise required by law.
